This paper presents research conducted during two coffee farming seasons in Costa Rica. The study examined coffee farmers’ weed management practices and is presented in the form of a case study of small-scale farmers’ use of labor and herbicides in weed management practices. Over 200 structured interviews were conducted with coffee farmers concerning their use of hired labor and family labor, weed management activities, support services, and expectations about the future of their coffee production. ANOVA and regression analyses describe the (...) relationships between farm size, labor, and herbicide use, and three farm types (i.e., conventional, semi-conventional, and organic). Based on findings regarding the amount of labor used to manually control weeds on different types of farms (large farms, small conventional, semi-conventional, and organic farms) I am able to challenge small conventional farmers’ perceived need for herbicide use. Semi-structured interviews of coffee farmers and extension workers further revealed a dominant role played by agro-chemical companies in assisting farmers with production problems, and documented a high transaction cost for information provided from elsewhere. Chemical companies hire extension workers to visit farmers at their farms, free of charge, to offer recommendations on how to treat different pest problems, while government and cooperative extension agents charge for the service. There is a need to increase the amount of resources available to the National Coffee Institute to fund one-on-one farmer support services in order to balance the influence of agro-chemical company representatives and allow farmers to make better decisions regarding weed management. It was endorsed by the General Assembly of the UN in 2005, and unanimously reaffirmed by the Security Council in 2006 and 2009. UN Secretary-General Ban Ki-moon has identified the challenge of implementing RtoP as one of the cornerstones of (...) his Secretary-Generalship. The principle has also become part of the working language of international engagement with humanitarian crises and has been debated in relation to almost every recent international crisis âe" including Sudan, Sri Lanka, Myanmar, Georgia, the Democratic Republic of Congo, Darfur and Somalia. Concentrating mainly on implementation challenges including the prevention of genocide and mass atrocities, strengthening the UNâes capacity to respond, and the role of regional organizations, this book introducing readers to contemporary debates on R2P and provides the first book-length analysis of the implementation agenda. Tomasello, Kruger & Ratner make the very interesting and valid point that the transmission of culture must depend on understanding others' minds. Culture is shared among a people and is passed on to progeny. The sharing of culture implies that the purpose of (and therefore the meaning behind) any given cultural element (behavioral tradition, word, or artifact) is understood. Because meaning or purpose emanates from minds, something about others' minds must be understood in order to truly learn some element of (...) a culture. It thus makes sense that cultural learning should depend on social-cognitive skills. But what exactly is cultural learning?There are two rival interpretations of the term cultural learning. In the first, one would define a given type of cultural learning by the type of social-cognitive skill it entails. For example, imitative learning would be defined as any learning of a cultural element in which another's goals or intentions are taken into account. This definition of cultural learning, however, would force Tomasello et al.'s argument into a circle: Imitative learning relies on this social-cognitive skill because imitative learning is defined as learning that relies on this social-cognitive skill. The concept of moral distress comes from nursing ethics, and was initially defined as ‘…when one knows the right thing to do, but institutional constraints make it nearly impossible to pursue the right course of action’. There is a large body of literature associated with moral distress, yet multiple definitions now exist, significantly limiting its usefulness. We undertook a systematic review of the argument-based bioethics literature on this topic as the basis for a critical appraisal, identifying 55 papers for analysis. (...) We found that moral distress is most frequently framed around individual experiences of distress in relation to local practices and constraints, and understood in terms of power relations and workplace hierarchies. This understanding is directly derived from, and often still seen as specific to, nursing. Frequently the perspective of the morally distressed individual is privileged. Understandings of moral distress have evolved towards an ‘occupational health approach’, with the assumption that moral distress should be measured and prevented. Counter-perspectives were identified, highlighting conceptual problems. Based on our review, we propose a redefinition of moral distress: ‘Ethical unease or disquiet resulting from a situation where a clinician believes they have contributed to avoidable patient or community harm through their involvement in an action, inaction or decision that conflicts with their own values’. This definition is specific enough for research use, anchored in clinicians’ professional responsibilities and concerns about harms to patients, framed relationally rather than hierarchically, and amenable to multiple perspectives on any given morally distressing situation. The article presents musicological and existentialist philosophical discourses on renaissance and baroque structures in the works of two contemporary classical composers. The existentialist point of view is imposed due to the examination of contemporary music works in which historically conditioned practices are also found. Being and Time and Introduction to Metaphysics by Martin Heidegger serve as a starting point for the reflections. The two works D’Om Le Vrai Sens by Kaija Saariaho and Concerto Grosso “Sun Reflections” by Yordan Goshev are (...) stylistically very different but the first bears renaissance and the second – baroque features respectively. In consequence, Der Man or Das Man is defined by the opposition between renaissance humanism and the metaphysics of Being. (shrink)

In this paper we present two types of logics and \ ) where certain p-adic functions are associated to propositional formulas. Logics of the former type are p-adic valued probability logics. In each of these logics we use probability formulas K r,ρ α and D ρ α,β which enable us to make sentences of the form “the probability of α belongs to the p-adic ball with the center r and the radius ρ”, and “the p-adic distance between the probabilities of (...) α and β is less than or equal to ρ”, respectively. Logics of the later type formalize processes of thinking where information are coded by p-adic numbers. We use the same operators as above, but in this formalism K r,ρ α means “the p-adic code of the information α belongs to the p-adic ball with the center r and the radius ρ”, while D ρ α,β means “the p-adic distance between codes of α and β are less than or equal to ρ”. The corresponding strongly complete axiom systems are presented and decidability of the satisfiability problem for each logic is proved. (shrink)

This article presents a theoretical model of the self processes involved in autobiographical memories and proposes competing hypotheses for the role of visual perspective in autobiographical memory retrieval. Autobiographical memories can be retrieved from either the 1st person perspective, in which individuals see the event through their own eyes, or from the 3rd person perspective, in which individuals see themselves and the event from the perspective of an external observer. A growing body of research suggests that the visual perspective from (...) which a memory is retrieved has important implications for a person’s thoughts, feelings, and goals, and is integrally related to a host of self-evaluative processes. We review the relevant research literature, present our theoretical model, and outline directions for future research. (shrink)

Designing an ontology that meets the needs of end-users, e.g., a medical team, is critical to support the reasoning with data. Therefore, an ontology design should be driven by the constant and efficient validation of end-users needs. However, there is not an existing standard process in knowledge engineering that guides the ontology design with the required quality. There are several ontology design processes, which range from iterative to sequential, but they fail to ensure the practical application of an ontology and (...) to quantitatively validate end-user requirements through the evolution of an ontology. In this paper, an ontology design process is proposed, which is driven by end-user requirements, defined as Competency Questions. The process is called CQ-Driven Ontology DEsign Process and it includes activities that validate and verify the incremental design of an ontology through metrics based on defined CQs. CODEP has also been applied in the design and development of an ontology in the context of a Mexican Hospital for supporting Neurologist specialists. The specialists were involved, during the application of CODEP, in collecting quality measurements and validating the ontology increments. This application can demonstrate the feasibility of CODEP to deliver ontologies with similar requirements in other contexts. (shrink)

Educators across the nation are engaged in well-meaning efforts to address diversity in schools given the current context of NCLB, Race to the Top, and the associated pressures of standardization and accountability. Through rich ethnographic accounts of teachers in two demographically different secondary schools in the same urban district, Angelina E. Castagno investigates how whiteness operates in ways that thwart even the best intentions and common sense—thus resulting in educational policies and practices that reinforce the status quo and protect (...) whiteness rather than working toward greater equity. Whereas most discussions of the education of diverse students focus on the students and families themselves, _Educated in Whiteness_ highlights the structural and ideological mechanisms of whiteness. In schools, whiteness remains dominant by strengthening and justifying the status quo while simultaneously preserving a veneer of neutrality, equality, and compassion. Framed by critical race theory and whiteness studies, this book employs concepts like interest convergence, a critique of liberalism, and the possessive investment in whiteness to better understand diversity-related educational policy and practice. Although in theory most diversity-related educational policies and practices are intended to bring about greater equity, too often in practice they actually maintain, legitimate, and so perpetuate whiteness. Castagno not only sheds light on this disconnect between the promises and practices of diversity-related initiatives but also provides insight into _why_ the disconnect persists. (shrink)

Mercier and Sperber (MS) have ventured to undermine an age-old assumption in logic, namely the presence of premise-conclusion structures, in favor of two novel claims: that reasoning is an evolutionary product of a reason-intuiting module in the mind, and that theories of logic teach next to nothing about the mechanisms of how inferences are drawn in that module. The present paper begs to differ: logic is indispensable in formulating conceptions of cognitive elements of reasoning, and MS is no less exempt (...) from taking notice of premise-conclusion structures than the commonplace theories of reasoning are. Our counterclaim is realized in terms of diagrammatic reasoning dating back to Charles Peirce’s pragmaticism. The upshot is that pragmatist logic restores the premise-conclusion structures in argumentation, supplants reason-intuition module with logical content, and validates good reasoning as an indispensable resource evident to all rational minds that claim ownership of reason and understanding. Finally, the first book started Peirceana. Peirceana is expected as a new series that provides access to both Peirce’s mostly unpublished late works and secondary papers, in which ideas of this American philosopher are developed. This edition is opened with three volumes on Peirce’s manuscripts on “Logic of the Future.” The thinker gave this definition to his theory of existential graphs, i.e., a diagrammatical logical project that includes three sections. The sections can roughly correspond to propositional logic, first-order logic and (...) modal logic. The theory of existential graphs is a particular conception. It predicts ideas of proof theory, mathematics of continuity, and cognitive sciences. Besides, it has an impressive philosophical foundation and perfectly emphasizes the importance of diagrammatic notations. Since many writings are published here for the first time, the edition per se is a significant event for the history of logic. However, Peirceana can do more than this. It urges to think of how the logic of 20‒21st centuries would have looked like if Peirce’s intentions were discovered earlier. At the same time, it clarifies the ground for contemporary investigations. Today we have a bunch of papers about various non-classical modifications, extensions, restrictions, and applications of the original theory. Peirceana is projected as the publication that can gather specialists (logicians, philosophers, as well as IT and cognitive science scholars) who are interested in the development of Peirce’s approach. It lets the readers reconsider our ordinary logical conceptions (e.g., reasoning, logical and language analysis, and others) as well as the conventional understanding of the evolution of modern logic. The current paper has two objectives: firstly, it estimates this diplomatic partly critical edition with its several thoroughly elaborated introductions, and secondly, it briefly introduces the existential graphs theory. Although marijuana use is highly prevalent among university students in Argentina, little is known about the factors that distinguish frequent marijuana users from sporadic users. For this reason, the present study investigated the possible variations in the contexts of consumption, motives for consumption, perceived norms, and protective behavioral strategies among university students with frequent or sporadic marijuana use, and analyzed the usefulness of this set of variables to distinguish between these two types of users. For this purpose, a sample of (...) 1083 Argentine university students completed an online survey on substance use. In particular, this work was conducted with the subsample that reported using marijuana in the last 30 days. The survey asked about marijuana use and associated negative consequences, as well as motives for use, perceived social norms, and protective behavioral strategies. As a result, frequent users had a higher number of negative consequences than sporadic users, and a distinctive profile was found on a set of variables. At the multivariate level, cheerleading motives, protective behavioral strategies, solo use, and college party use discriminated significantly between the two classes of users. Overall, the findings revealed heterogeneous subpopulations of marijuana users that differ not only in use and its consequences, but also in contexts of use and in a set of relevant variables. These distinct subpopulations require different and specific interventions. (shrink)

Western Kansas is one of the most important agricultural regions in the world. Most agricultural production in this semi-arid region depends on the consumption of nonrenewable groundwater from the High Plains Aquifer, which will be 70 % depleted by 2070. The problem of depletion has drawn significant attention from local citizens and policymakers at the federal, state, and local levels for at least 40 years, resulting in a variety of policies and institutions to manage groundwater from the aquifer as a (...) common pool resource. Yet depletion has persisted. We explain this conundrum as an outcome of a mismatch between the scale of resource management, which has become more intensively local, and the scale of resource exchange, which has rendered the High Plains Aquifer a global common pool resource. We then explain the deeper, structural origins of the management–exchange scale mismatch. Drawing on concepts from structural human ecology theory and empirical evidence from Southwest Kansas, we show that agriculture is predicated on local metabolic rift in the hydrological cycle that is exacerbated through ecological unequal exchange with higher-income, core areas beyond the region. We conclude by highlighting two key policies that, if implemented together, may lessen the deleterious effects of these structural dynamics and thus promote a more sustainable relationship between society and environment in this region and other water-scarce regions that are net-exporters of groundwater. RESUMO No presente estudo de casos, discutimos a produção de sentidos carregados com elementos prosódicos no começo da vida. Alinhamos essa discussão com observações de Bakhtin acerca de características da enunciação. Com esse alinhamento investimos em explicações sobre o status linguístico da prosódia nos diálogos entre adulto e bebês em situação de aquisição de linguagem. Os dados foram registros videográficos da interação de duas díades adulto-criança, uma francesa e uma brasileira, durante atividades cotidianas1. Nas análises, comparamos variações da curva entonacional (...) dos enunciados dos adultos com vocalizações dos bebês. Nos resultados discutimos como essas variações refletiram exercícios de posições axiológicas, discutidas no âmbito da apropriação enunciativa. Concluímos que os aspectos prosódicos são recursos principais para enunciação no começo da vida e vinculam as práticas com a linguagem ao desenvolvimento humano. ABSTRACT In the present case study, we discuss meaning production, which is full of prosodic elements in early life. We align this discussion with Bakhtin's observations about the characteristics of enunciation. With this alignment, we invested in explanations about the linguistic status of prosody in dialogues between adults and babies in the process of language acquisition. The data we discuss consist of videographic records of interactions of two adult-child dyads, one French and one Brazilian, both recorded during daily life activities.1 In the analyses, we compared variations in the intonational curves of the adults’ utterances with the babies’ vocalizations. In the results, we discuss how these variations reflected in practices of axiological positions, discussed in the context of enunciative appropriation. We conclude that prosodic aspects are the main resources for enunciation at the beginning of life and they enable the link between language practices and human development. (shrink)

During the 1990s, international society increasingly recognised that states who abuse their citizens in the most egregious ways ought to lose their sovereign inviolability and be subject to humanitarian intervention. The emergence of this norm has given renewed significance to the debate concerning what it is about humanitarian intervention that makes it legitimate. The most popular view is that it is humanitarian motivations that legitimise intervention. Others insist that humanitarian outcomes are more important that an actor's motivations, pointing for instance (...) to the ousting of the Khmer Rouge by Vietnam. Given the centrality of this debate, this article reinvestigates the ?motives versus outcomes? debate and suggests an alternative reading based on the classic Just War tradition. It argues that an actor's intentions are vital to assessing the legitimacy of an intervention. (shrink)

The purpose of this study is to encourage and highlight discussion on how to improve the teaching of research ethics in institutions of higher education in Malaysia. Drawing on semi-structured interviews with 21 academics in a research-intensive university in Malaysia, interviewees agreed on the importance of emphasizing the subject of research ethics among students, as well as academics or researchers. This study reveals that participants felt that there is an urgent need to improve the current awareness and knowledge of issues (...) related to misconduct in research among students and academics. The results of this study indicate a need for better teaching on the subject of research ethics in order to prevent misconduct in research. Finally, it concludes with suggestions that there should be a clear definition of research misconduct, to include consequences when engaging in misconduct; a separate research ethics syllabus for pure and social sciences should be conducted; research ethics should be implemented as a core subject, and there should be an early intervention and continuous learning of research ethics, with an emphasis on ethics training. While pre-implantation genetic diagnosis is available and legal in Malaysia, there is an ongoing controversy debate about its use. There are few studies available on individuals’ attitudes toward PGD, particularly among those who have a genetic disease, or whose children have a genetic disease. To the best of our knowledge, this is, in fact, the first study of its kind in Malaysia. We conducted in-depth interviews, using semi-structured questionnaires, with seven selected potential PGD users regarding their knowledge, attitudes and decisions (...) relating to the use PGD. The criteria for selecting potential PGD users were that they or their children had a genetic disease, and they desired to have another child who would be free of genetic disease. All participants had heard of PGD and five of them were considering its use. The participants’ attitudes toward PGD were based on several different considerations that were influenced by various factors. These included: the benefit-risk balance of PGD, personal experiences of having a genetic disease, religious beliefs, personal values and cost. The study’s findings suggest that the selected Malaysian participants, as potential PGD users, were supportive but cautious regarding the use of PGD for medical purposes, particularly in relation to others whose experiences were similar. More broadly, the paper highlights the link between the participants’ personal experiences and their beliefs regarding the appropriateness, for others, of individual decision-making on PGD, which has not been revealed by previous studies. Published data and studies on research misconduct, which focuses on researchers in Malaysia, is still lacking, therefore, we decided that this was an area for investigation. This study provides qualitative results for the examined issues through series of in-depth interviews with 21 researchers and lecturers in various universities in Malaysia. The aims of this study were to investigate the researchers’ opinions and perceptions regarding what they considered to be research misconduct, their experience with such misconduct, and the factors that contribute (...) to research misconduct. Our findings suggest that the most common research misconducts that are currently being witnessed in Malaysian universities are plagiarism and authorship disputes, however, researchers seldom report incidents of research misconduct because it takes too much time, effort and work to report them, and some are just afraid of repercussions when they do report it. This suggests possible loopholes in the monitoring system, which may allow some researchers to bypass it and engage in misconduct. This study also highlights the structural and individual factors as the most influential factors when it comes to research misconduct besides organizational, situational and cultural factors. Finally, this study highlights the concerns of all participants regarding the ‘publish or perish’ pressure that they believe would lead to a hostile working environment, thus enhancing research misconduct, as researchers tend to think about their own performance rather than that of whole team or faculty. Consequently this weakens the interpersonal relationships among researchers, which may compromise the teaching and supervision of junior researchers and research students. (shrink)

Second, we found that unethical authorship practices are not so unusual among academia although the exact numbers of incidents are unknown due to the fact that such practices are seldom reported. Third, our interviewees revealed that the culture of ‘publish or perish’ could be the main contributor (...) to unethical practices of authorship because publication records are the main criteria for researcher's career evaluation besides, others, which are set by the university.ConclusionIt was suggested that the institution must play a proactive role in educating and promoting awareness on authorship guidelines, through education and training, ethical leadership as well as promoting the importance of publication ethics. Lemogne and colleagues offer an interesting extension to their previous work on visual perspective and depression: Individuals at-risk for depression , without a history of mood disorders, report retrieval of positive memories from the 3rd person perspective. Their findings suggest that the retrieval of positive experiences from the 3rd person perspective may be a risk-factor for depression, not just a lingering consequence of it. Their study, however, also reports a genetic association in a severely underpowered sample. Rather than focusing on (...) gene x environment interactions, which large, well-powered studies on related phenotypes have failed to detect, a greater understanding of the phenomenology of visual perspective may be a more fruitful avenue for future research. The debate on the nature of the European Union hasbecome a test case of the kind of political andinstitutional arrangements appropriate in an age ofglobalization. This paper explores three views of theEU. The two main positions that have hithertoconfronted each other appeal to either cosmopolitan orcommunitarian values. Advocates of the former arguefor some form of federal structure in Europe and areconvinced that the sovereignty of the nation statebelongs to the past. Proponents of the latter make acase on both socio-political and (...) normative grounds fora Europe of nations. However a third position,favoured by the authors, is gaining ground. This viewcombines cosmopolitan and communitarian conceptions.It emphasises the mixed nature of the European polityand conceives the constitutionalization process asopen-ended. The paper concludes that from this perspectivea bricoleur's Europe of ‘bits and pieces’may not necessarily lack justification and legitimacy. (shrink)

This work examines the structure of discourses on homosexuality, taking the nature-versus-nurture question as a case study, in order to display the incoherency that results from taking such questions for granted. This paper critically explores the alleged neutrality and objectivity of discourses on sexuality, and within this exploration, a breakdown of the categories of sexuality, sex, gender, and nature occurs. What is shown is that the breakdown of these categories renders the nature-versus-nurture Question itselfquite questionable.

Informal science learning sites create opportunities for children to learn about science outside of the classroom. This study analyzed children’s learning behaviors in ISLS using video recordings of family visits to a zoo, children’s museum, or aquarium. Furthermore, parent behaviors, features of the exhibits and the presence of an educator were also examined in relation to children’s behaviors. Participants included 63 children and 44 parents in 31 family groups. Results showed that parents’ science questions and explanations were positively related to (...) children observing the exhibit. Parents’ science explanations were also negatively related to children’s science explanations. Furthermore, children were more likely to provide science explanations when the exhibit was not interactive. Lastly there were no differences in children’s behaviors based on whether an educator was present at the exhibit. This study provides further evidence that children’s interactions with others and their environment are important for children’s learning behaviors. (shrink)

Where it was once a term of art employed by a handful of likeminded countries, activists, and scholars, but regarded with suspicion by much of the rest of the world, RtoP has become a commonly accepted frame of reference for preventing and responding to mass atrocities.

Recent years have seen a revival of interest in Michael Walzer's doctrine of ‘supreme emergency’. Simply put, the doctrine holds that, when a state confronts an opponent who threatens annihilation, it can be morally legitimate to violate one of the cardinal rules of the war convention – the principle of non-combatant immunity. Walzer cites the case of Britain's decision to bomb German cities in 1940 as a case in point. Although the theory of supreme emergency has been scrutinised, the historical (...) case that Walzer refers to has not been looked at in depth. This article seeks to remedy this problem by asking whether the principle actors involved in the decision to bomb German cities understood themselves to be in a supreme emergency. It argues that the British leadership never openly admitted that they were in fact targeting German civilians, and that the principle reason for this was a widespread belief that the British and American publics would not support such a campaign. As a result, throughout the war, the British government publicly maintained the fiction that the devastation of German cities was a collateral product of attacks on its industrial infrastructure. This, in turn, suggests that liberal societies – even those facing imminent destruction – do not tend to support a relaxing of the rules of non-combatant immunity, suggesting that the prohibition on deliberately killing non-combatants may be more embedded than has hitherto been thought. This article explores the different moral and legal arguments used by protagonists in the debate about whether or not to conduct a humanitarian intervention in Darfur. The first section briefly outlines four moral and legal positions on whether there is (and should be) a right and/or duty of humanitarian intervention: communitarianism, restrictionist and counter-restrictionist legal positivism and liberal cosmopolitanism. The second section then provides an overview of the Security Council's debate about responding to Darfur's crisis, showing how its policy was (...) influenced by both normative concerns and hard-nosed political calculations. The article concludes by asking what Darfur's case reveals about the legitimacy and likelihood of humanitarian intervention in such catastrophes and the role of the UN Security Council as the primary authorising body for the use of international force. The authors argue that this case demonstrates that for the cosmopolitan/counter-restrictionist case to prevail pivotal states need to put humanitarian emergencies on the global agenda and express a willingness to act without Council authorisation, though the question of how to proceed in cases where the Council is deadlocked remains vexed. This book, first published in 1938, is based upon the Muirhead lectures on political philosophy delivered in the University of Birmingham in January and February of 1938. This title was intended to be of interest to students and scientific workers in the belief that Marxism will prove valuable to them in their scientific work, as well as to a wider audience.

What does the world's engagement with the unfolding crisis in Darfur tell us about the impact of the Iraq war on the norm of humanitarian intervention? Is a global consensus about a “responsibility to protect” more or less likely? There are at least three potential answers to these questions. Some argue that the merging of strategic interests and humanitarian goods amplified by the intervention in Afghanistan makes it more likely that the world's most powerful states will act to prevent or (...) halt humanitarian crises. Others insist that the widespread perception that the United States and its allies “abused” humanitarian justifications to legitimate its invasion of Iraq has set back efforts to build a global consensus about humanitarian action. A third group argues that the “responsibility to protect” inhibits the potential for abuse and, as a result, consensus is likely to strengthen post-Iraq for precisely this reason. Through a detailed study of the international engagement with Darfur, I suggest that the latter two arguments have merit but need to be adjusted. I argue that the humanitarian intervention norm has changed in two subtle ways. First, while the strength of the norm itself has not changed, the credibility of the United States and U.K. as “norm carriers” has been significantly undermined. Second, while the “responsibility to protect” has been invoked to support international activism, it has also re-legitimated anti-interventionist arguments. (shrink)

According to the Supreme Court of Canada, Aboriginal title is a property right, albeit of a distinctive kind. Most significantly, the right is subject to an inherent limit: title lands cannot be used in a way that deprives present and future generations of the right to use the land. Aboriginal title is also encumbered by a restraint on alienation, and has its source in Aboriginal legal systems that predate and survive the assertion of Crown sovereignty. In this paper, we argue (...) that these features of Aboriginal title are not burdensome judicial innovations on a property right, but are instead the essential contours of a sovereign right. That is, the Court’s own description of Aboriginal title does not comport with sound theoretical understandings of a property right. Aboriginal title is much more akin to a right of sovereignty—the right to make laws about the use of a territory. Aboriginal title is the right of law-making jurisdiction over the title lands. The existing literature, while edging towards the view that Aboriginal title is a sovereign right, has lacked the unifying theoretical basis needed to decisively dispatch the Court’s property paradigm. In particular, all extant accounts find the inherent limit inexplicable. The account in this article theorizes and explains the inherent limit, as well as all of the sui generis elements of Aboriginal title, and shows their interconnectedness. Our view additionally answers a number of questions that the Court’s property paradigm does not, including: (1) what laws primarily govern title lands; (2) who has standing to question whether any particular use of title land violates the inherent limit; (3) what is the status of private land interests that overlap with Aboriginal title lands; and (4) how should the doctrine of Aboriginal title be updated in light of jurisprudential developments emphasizing that Indigenous peoples never ceded their sovereignty? [Between Cosmopolis and Community: Three Models of Rights and Democracy within the European Union; .].

Pre-implantation genetic diagnosis became well known in Malaysia after the birth of the first Malaysian ‘designer baby’, Yau Tak in 2004. Two years later, the Malaysian Medical Council implemented the first and only regulation on the use of Pre-implantation Genetic Diagnosis in this country. The birth of Yau Tak triggered a public outcry because PGD was used for non-medical sex selection thus, raising concerns about PGD and its implications for the society. This study aims to explore participants’ perceptions of the (...) future implications of PGD for the Malaysian society. We conducted in-depth interviews with 21 participants over a period of one year, using a semi-structured questionnaire. Findings reveal that responses varied substantially among the participants; there was a broad acceptance as well as rejection of PGD. Contentious ethical, legal and social issues of PGD were raised during the discussions, including intolerance to and discrimination against people with genetic disabilities; societal pressure and the ‘slippery slope’ of PGD were raised during the discussions. This study also highlights participants’ legal standpoint, and major issues regarding PGD in relation to the accuracy of diagnosis. At the social policy level, considerations are given to access as well as the impact of this technology on families, women and physicians. Given these different perceptions of the use of PGD, and its implications and conflicts, policies and regulations of the use of PGD have to be dealt with on a case-by-case basis while taking into consideration of the risk–benefit balance, since its application will impact the lives of so many people in the society. In this article, it is hypothesized that a fundamental chemical reactivity exists between some non‐lipid constituents of cellular membranes and ester‐based lipids, the significance of which is not generally recognized. Many peptides and smaller organic molecules have now been shown to undergo lipidation reactions in model membranes in circumstances where direct reaction with the lipid is the only viable route for acyl transfer. Crucially, drugs like propranolol are lipidated in vivo with product profiles that are comparable to those produced in (...) vitro. Some compounds have also been found to promote lipid hydrolysis. Drugs with high lytic activity in vivo tend to have higher toxicity in vitro. Deacylases and lipases are proposed as key enzymes that protect cells against the effects of intrinsic lipidation. The toxic effects of intrinsic lipidation are hypothesized to include a route by which nucleation can occur during the formation of amyloid fibrils. (shrink)

While it is no secret that Valerius Flaccus’Argonauticaexplores civil-war themes at great length, the conflicts arising on the island of Peuce between the Colchians and the Argonauts and within the Argonautic party itself in the epic's final book (8.217–467) have been overlooked in critical studies of Valerian civil war. This article argues that Valerius presents the conflicts on Peuce as examples of civil war—emphasizing the bonds of kinship between the conflicting parties and illustrating effects of this discord using imagery of (...) stasis and cosmic dissolution associated with civil war in the wider Latin literary tradition—and thus invites reflection on the development and manifestation of internecine strife within theArgonautica. Judicial review by constitutional courts is often presented as a necessary supplement to democracy. This book questions its effectiveness and legitimacy. Drawing on the republican tradition, Richard Bellamy argues that the democratic mechanisms of open elections between competing parties and decision-making by majority rule offer superior and sufficient methods for upholding rights and the rule of law. The absence of popular accountability renders judicial review a form of arbitrary rule which lacks the incentive structure democracy provides to ensure rulers (...) treat the ruled with equal concern and respect. Rights based judicial review undermines the constitutionality of democracy. Its counter-majoritarian bias promotes privileged against unprivileged minorities, while its legalism and focus on individual cases distort public debate. Rather than constraining democracy with written constitutions and greater judicial oversight, attention should be paid to improving democratic processes through such measures as reformed electoral systems and enhanced parliamentary scrutiny. Customer behavior, market dynamics, and technological advances have made it challenging for marketing theorists to provide comprehensive explanations and actionable insights. Although there are numerous substantive marketing frameworks, no formal marketing theory exists. This study aims to develop the first formal grounded theory in marketing by incorporating artificial intelligence and Forde's conceptual framework as a guiding lens. Charmaz's constructivist grounded theory tradition and Forde's conceptual framework and data analysis strategy were employed for this purpose. The data analysis strategy used with (...) grounded theory’s constant compare-and-contrast method comprises holistic and systems thinking, dramaturgical and situational analysis, perspective-taking, and deconstruction. To evaluate Glaser’s assertion that all is data, artificial intelligence was incorporated into the research as the data source for retrieving the theoretical samples to address the primary research question: How can Forde's conceptual framework and artificial intelligence be leveraged to develop a formal marketing theory grounded in evidence? Of significance was the emergence of democratic marketing behaviors and the normalization of anti-democratic marketing approaches leveraged to manipulate buyers or gain access to segments of customers. Buyers and sellers can simultaneously benefit from and be prejudiced by marketing exchange dynamics. This finding lends credibility to the newly emerged framework of strategic actions where empowerment and disempowerment are leveraged to achieve specific goals. Considering this finding, it is suggested that businesses view marketing as a symbiotic relationship between two power centers, buyers and sellers, who respectively strive to maintain human dignity and sustainability. Researchers are encouraged to apply the framework across substantive areas, international markets, public relations, political campaigns, and others. (shrink)

The publication of Angelova A. «Conception of “spiritual eldering” of Z. Schachter-Shalomi» is devoted to research gerontosophy ideas of one of the leaders of the World Jewish renewal movement. The organic combination of orthodox Judaism, Kabbalah and Hasidism, as well as Christian, Eastern and Sufi mysticism engendered very actual doctrine of “spiritual eldering” to the modern world. Promoting, translating texts of Jewish thinker and reformer Z. Schachter in Ukraine and neighbour countries will help to improve difficult gerontological situation of today´s (...) world, to go beyond negative stereotypes of perception of old age and aging. The publication of Angelova A. «Religious Gerontology: trends and prospects in the realities of an aging society» is devoted to the history of the emergence, development and also to the elucidation of the subject matter of the latest interdisciplinary section of religious studies. The main problems of religious gerontology are defined and classified, its perspective theoretical and applied directions are designated. The importance of actively popularizing the findings of western gerontologists on the issues of spirituality, religiosity and aging was underscored. (...)
